Consultation: Proposed Submission Local Green Spaces Plan
South Derbyshire District Council has taken on board the comments received during the Draft Local Green Spaces Plan consultation and have made amendments to the Plan and the accompanying documents where necessary.
The District Council consulted on its Proposed Submission Local Green Spaces Plan together with the supporting documents listed below.
- Sustainability Appraisal (SA) - this document assesses the environmental, economic and social impact that the proposed Local Green Spaces Plan will have on the District.
- Consultation Statement – this outlines the consultations that have been undertaken previously, together with how we consulted, and presents a summary of the main issues raised and how they have been considered.
South Derbyshire’s Proposed Submission Local Green Spaces Plan sets out areas of land that are of value to the local community and have been proposed for local green space designation. The Plan will be used to guide development (along with the rest of the development plan) through the determination of planning applications in the District.
The NPPF sets out the following in regards to the soundness of a plan:
a) Positively prepared – providing a strategy which, as a minimum, seeks to meet the area’s objectively assessed needs; and is informed by agreements with other authorities, so that unmet need from neighbouring areas is accommodated where it is practical to do so and is consistent with achieving sustainable development;
b) Justified – an appropriate strategy, taking into account the reasonable alternatives, and based on proportionate evidence;
c) Effective – deliverable over the plan period, and based on effective joint working on cross-boundary strategic matters that have been dealt with rather than deferred, as evidenced by the statement of common ground; and
d) Consistent with national policy – enabling the delivery of sustainable development in accordance with the policies in this Framework.

Legal and Procedural Requirements:
If you wish to submit representations in relation to the legal compliance of the Proposed Green Spaces Plan, you should consider: whether it has been prepared in accordance with relevant national policies, Local Plan Regulations, Statement of Community Involvement and subjected to Sustainability Appraisal.

Duty to Co-operate
Section 110 of the Localism Act 2011 introduced a ‘Duty to Co-operate’. Local Authorities are required to work with neighbouring authorities and other prescribed bodies in preparing development plan documents.
Local authorities must “engage constructively, actively and on an ongoing basis” during the preparation of Local Plans when they relate to strategic matters. Strategic matters are defined as development including infrastructure that “would have a significant impact on at least two planning areas”.
